VIDEO EXPLAINER | 8 NOVEMBER 2026
As per the video, the question was whether backward class status goes along when a person changes religion. The Supreme Court said that it does not, not automatically. The Tamil Nadu appeal was dismissed on 15 October 2026 in the case Secretary to Government versus Sameer Ahamed, and the judgment was written by Justice Prashant Kumar Mishra.
What happened
The bench had Justice Prashant Kumar Mishra, who wrote the judgment, along with Justice Shree Chandrashekhar.
Sameer Ahamed was born a Hindu and converted to Islam in 2015. He then asked for a Muslim Lebbai community certificate, which the Tahsildar rejected.
A Tamil Nadu Government Order of March 2024 allows converts to ask for a BC Muslim certificate. The Madras High Court Division Bench set aside that Government Order in June 2026. The High Court said that an executive order cannot override legal principles and precedents.
The State argued that people who are already disadvantaged should not lose the benefit only because of conversion.
The Supreme Court said that earlier backwardness does not by itself give membership of a notified backward class. A declaration of conversion is also not proof of that membership. The Court found that the Government Order had no common nexus and rested only on presumption.
For people who return to Hinduism, the Court said that an independent and fact specific assessment is needed in every case.
Background and the rules behind it
The video places the dispute inside two constitutional provisions. Article 16 clause 4 allows reservation of posts for backward classes. Article 341 lets the President decide the list of Scheduled Castes by a public notification.
The point of the ruling is about how membership works. A person becomes part of a notified backward class because of the notification, not because of an earlier social condition and not because of a personal declaration.
That is why the Government Order failed. It tried to give a benefit by assuming the backwardness would travel with the person, and the Court held that an assumption cannot replace the legal test.
The Madras High Court had reached the same result in June 2026 on a different basis, that an executive order cannot override legal principles and precedents. The Supreme Court then dismissed the State’s appeal.
The video says this position is as of 29 October 2026.
Key terms
- Backward class status: Membership of a notified backward class, which decides eligibility for reservation.
- Government Order: An executive order. The Madras High Court held it cannot override legal principles and precedents.
- Common nexus: A rational link between the classification and the object. The Court found it missing in the Government Order.
- Presumption: An assumption. The Court said the Government Order rested only on it.
- Notified backward class: A class recognised through an official notification.
Constitutional / Legal / Institutional framework
- Article 16 clause 4: allows reservation of posts for backward classes.
- Article 341: the President notifies the list of Scheduled Castes by public notification.
- Executive orders cannot override legal principles and precedents (Madras High Court, June 2026).
- Supreme Court: earlier backwardness and a declaration of conversion do not by themselves give membership of a notified backward class.
CLAT angle
- Backward class status does not go with a change of religion automatically.
- Case: Secretary to Government versus Sameer Ahamed; appeal dismissed 15 October 2026; judgment by Justice Prashant Kumar Mishra.
- Government Order of March 2024 (BC Muslim certificate for converts) was set aside by the Madras High Court in June 2026.
- For people returning to Hinduism, assessment is independent and fact specific in every case.

Mnemonic / memory hook
Notification, not declaration.
Membership comes from the notification. Old backwardness does not carry it, a declaration of conversion does not prove it, and an executive order cannot assume it.
Why this matters for exams
Questions on this case usually ask who decides backward class membership and what does not decide it. The answer in the video is that the notified list decides, while earlier backwardness and a declaration of conversion do not.
A second favourite is the hierarchy. A Government Order is an executive instrument, and the Madras High Court held it cannot override legal principles and precedents. The Supreme Court added that the order lacked a common nexus and rested only on presumption.
Finally, remember the constitutional anchors. Article 16 clause 4 on reservation of posts for backward classes, and Article 341 on the President’s notification of Scheduled Castes.
