SC Stray Dogs Ruling — Art 21 vs ABC Rules 2023 (May 2026)

On May 19, 2026, the Supreme Court of India delivered sweeping directions in the suo motu stray dogs case, mandating nationwide implementation of the Animal Birth Control (ABC) Rules, 2023, permitting euthanasia of rabid and aggressively dangerous dogs, and holding that stray dogs found inside institutional premises (schools, hospitals, airports, railway stations) cannot claim re-release at the same spot. The 3-Judge Bench of Justices Vikram Nath, Sandeep Mehta and N V Anjaria said the State cannot remain a “passive spectator” to the dog-bite crisis and that the citizen’s right to move freely under Article 19(1)(d), read with Article 21, must prevail.
