Kerala sets up India’s first Dept for the Elderly (CLAT 2027)

Kerala’s new Congress-led government has notified India’s first dedicated Department for Welfare of Elderly People. With 16.5% of Kerala’s population above 60 (vs 10.1% national) in 2021 and a projected 22.8% by 2036, the move spotlights India’s demographic transition, the MWPSC Act 2007 and Art. 41 of the Constitution — a high-yield zone for CLAT 2027 GK + Legal.

Constitutional & Statutory Framework

Art. 41 (DPSP) — State to make effective provision for public assistance in old age, sickness and disablement. Art. 21 — right to dignified life extends to elderly (Ashwani Kumar v UoI, 2019). Maintenance & Welfare of Parents and Senior Citizens Act, 2007 — Sec. 4 enables senior citizens (60+) to claim maintenance up to ₹10,000/month from children/relatives via a Maintenance Tribunal. Sec. 23 — gifts/transfers by senior citizen are voidable if transferee fails to provide basic amenities.
