Citizenship Rules Amendment 2026: Pak, Bangladesh, Afghan Passport Surrender Mandatory

The Ministry of Home Affairs has notified the Citizenship (Amendment) Rules, 2026, inserting a new paragraph in Schedule IC of the Citizenship Rules, 2009. Persons of Indian origin holding Pakistani, Bangladeshi or Afghan passports who apply for Indian citizenship by registration (Section 5) or naturalisation (Section 6) must now formally declare such passports and undertake to surrender them within 15 days of approval.

The surrender is routed either through the Senior Superintendent of Police of the district or, in the MHA route, the Joint Secretary, MHA. The amendment also rolls out electronic Overseas Citizen of India (e-OCI) cards and a fully online application system.

Constitutional Framework

Article 11 of the Constitution grants Parliament plenary power to regulate citizenship by law. The Citizenship Act, 1955 is the parent statute. Section 5 covers registration (PIOs, OCI converts, spouses), Section 6 deals with naturalisation (ordinarily 11 years’ aggregate residence), and Section 9 provides that voluntary acquisition of foreign citizenship automatically terminates Indian citizenship. The Foreigners Act, 1946 governs entry, presence and departure of foreigners.
