๐ฐ What Happened
The Centre and Delhi government have rolled out PM-UDAY 2.0 with a SWAGAM portal that opened on April 24, 2026. Of Delhi’s 1,731 unauthorised colonies, 1,511 will be regularised on an ‘as-is where-is’ basis โ no layout-plan requirement, existing homes deemed legally valid, conveyance deed in 45 days. The original PM-UDAY (Pradhan Mantri Unauthorised Colonies in Delhi Awas Adhikar Yojana, 2019) had issued only ~40,000 conveyance deeds for the ~4.5 million people across these colonies because of layout-plan complexities. The new framework appoints the ADM as single nodal officer, allows MCD-issued Regularisation Certificates, and ties into the Transit Oriented Development (TOD) Policy 2021 โ extending TOD to an additional 80 sq km along Metro/RRTS corridors.
๐ฏ Why It Matters for CLAT
Delhi’s unauthorised colonies house ~30% of its population and have long sat in a ‘no clear title, no formal services’ limbo. PM-UDAY 2.0 converts that into legal ownership โ unlocking mortgageability, RERA-grade resale, and access to GST-input credits for builders. The TOD bolt-on (FAR up to 500, 65% mandatory residential, 99 sq m affordable units) institutionalises high-density housing within 500 m of metro corridors. The combined push connects the 73rd-74th Constitutional Amendments (urban local bodies), the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Act 2019, and the Delhi (Special Provisions) Act 2011 into a single regularisation-cum-development framework.
๐ Key Concepts
- PM-UDAY 2019 โ registration via portal, conveyance deed, payment of regularisation charges; suffered from layout-plan bottleneck.
- PM-UDAY 2.0 + SWAGAM (Single Window Access for Government Assistance Module) โ online application, GIS survey in 7 days, deficiency memo in 15, deed in 45.
- ‘As-is where-is’ regularisation โ existing footprints accepted; no demolition for setback violations.
- TOD Policy 2021 โ 500 m influence zone around metro/RRTS; FAR up to 500; 65% mandatory residential; mixed-use compulsory.
- Delhi (Special Provisions) Act 2011 โ moratorium on punitive action against unauthorised constructions; extended multiple times.
- NCT of Delhi (Recognition of Property Rights) Act 2019 โ Parliament’s enabling Act for PM-UDAY.
- 73rd & 74th Constitutional Amendments (1992) โ urban local bodies, 12th Schedule, town planning function.
