On 12 October 2026, the Karnataka High Court struck down the part of the State’s 2022 SC/ST reservation law that had taken total reservation to 56 per cent. The law had raised Scheduled Caste reservation from 15 to 17 per cent and Scheduled Tribe reservation from 3 to 7 per cent, while OBC reservation stayed at 32 per cent. A Division Bench held that Section 3 is invalid insofar as aggregate reservation crosses 50 per cent, and struck down Section 4 on State services in full. Constitutional, Legal & Institutional Framework

  • Reservation and the 50% ceiling: Articles 15(4) and 16(4) enable reservation for backward classes; in Indra Sawhney v Union of India (1992) a nine-judge bench held that reservation should not ordinarily exceed 50%. The 10% EWS quota (103rd Amendment, 2019) was upheld in Janhit Abhiyan (2022).
  • The President: Article 52 provides for a President of India; Dr Kalam was the 11th President (2002–2007).
  • Law of armed conflict: Additional Protocol I (1977) to the Geneva Conventions of 1949, Article 52: civilian objects shall not be the object of attack or of reprisals.
  • Law of the sea: UNCLOS 1982, Article 38: all ships and aircraft enjoy the right of transit passage through straits used for international navigation; Article 44: transit passage shall not be suspended. India ratified UNCLOS in 1995.
CLAT 2027 Exam Angle

  • Legal Reasoning: the Karnataka ruling is a ready passage on the 50% rule, its “extraordinary situations” exception and partial invalidity (“insofar as”).
  • International law: civilian objects (AP I Art 52) and transit passage (UNCLOS Art 38) are principle-based questions CLAT can set on any conflict.
  • GK — Geography: Bab-el-Mandeb links the Red Sea and the Gulf of Aden; the Strait of Hormuz lies between Iran and Oman.
  • GK — Defence and personalities: INDRA (India–Russia), INS Sahyadri (Shivalik class); Kalam: born 1931, Bharat Ratna 1997, 11th President.
